Can Testimony or evidence from people in Kenya be relevant to the Obama birth mystery?
Relevance means that a piece of offerred evidence or testimony makes some proposition that is material to the case more or less likely to be true. Also, for evidence or testimony to be relevant its probative value must be greater than its prejudicial value. It has to be more likely to lead to light than just to more heat on the case, (inflaming issues but conveying not information about them). Another issue in the assessment of evidence is called "weight". Evidence might be technically relevant but be given no weight by any reasonable adjudicator because for example it comes from people raised in an animistic, pre-scientific, voodoo style culture that simply does not have a concept of "objective truth" such as would be required to take an Oath in court to tell the truth. Without a concept of objective truth, affidavits, testimony, sound recordings, or video recordings would be utterly meaningless. In many part of Africa and in the South Pacific region truth is what makes you happy to say, or it could be what makes your listener happy to hear you say, or it could be what makes your listener perk up and pay close attention to what you are saying, or it could be what makes your listener give you a protein bisquit, or a bottle of water. There is no universal idea about truth, truthtelling, or what constitutes truthtelling. The Western concept of "correspondence" between the words and the *facts*" is really up for grabs in most parts of Africa and the South Pacific. It's possible that nobody from those vast areas of the world could have anything "revevant" to say about any legal issue being adjudicated by an Article III Court, by an Article I investigative panel, or by an Article II administrative law judge. If the "people in Kenya" evidence is not relevant, then doesn't the birth in Hawaii issue become the primary issue? Wouldn't the long form birth certificate appear to be the centrally relevant piece of evidence in the case, given the fact that Obama and his mother both told the "birth in Hawaii story" (Note if they had both told a "birth in Kenya" story, then the INS regulations about overseas births to US citizens would seem to be the centrally relevant point. I'm perfectly happy to accept the idea that Obama was born in Kenya, but that he's still a US citizen, because his mother was, and had been for the requisite amount of time under the INS law. But if there are fraudulent documents in the case, such as a falsely obtained certificate of live birth based on a perjury my the mother, then that casts a different light on the matter, and further research may be required. Bottom line: the place of birth does matter, so the best evidence for that should be brought forward forthwith if it really does exist in a safe in Hawaii). A confirmation by the State of Hawaii is not good enough. If they have the "long form" birth certificate in a safe, like they say they do, we want the document. Why? The Best Evidence Rule! The adjudicator is entitled to the Best Evidence, not the second best evidence, not a certificate that the best evidence is being kept in a safe. Only the best evidence will do if it truly is available, just for the cost of opening a safe. Trust but verify. I'm not against Obama, not sorry to see him in office, not a conservative (or a liberal). I'm against societal turmoil that does not have to be there. I'm against needless friction and futile debates. I'm in favor of someone with authority opening the safe. If the document is there, bring it to the FBI Building, put it in a glass case, and let the appropriate authorities decide who can see it or handle it. This is a FEC related matter. We have laws. The DOJ should see that those laws are scrupulously followed so that friction can be avoided.
